How Logs Increase Truck Accident Risk

Semi-truck accidents can prove to be deadly and many of these accidents are caused when truck drivers falsify their logs. As a driver, you do not simply get behind the wheel and travel to your destination. There is extensive training required and certifications that need to be obtained before you start driving a semi-truck.

It is important to learn how to properly maneuver a vehicle of this size that weighs several tons and it is important to learn the reasons most semi-truck accidents happen. One of those big reasons is due to fatigue.

Commercial Truck Accident Claims

As previously mentioned, several of these accidents occur because the truck driver is driving while fatigued. This kind of negligence contributes to truck accidents and makes them liable in a claim. However, insurance companies will also do everything in their power to reduce the payout for these kinds of claims if they don't outright deny the claim altogether.

Drive Length Regulations

The Federal Motor Carrier Safety Administration has regulations in place that specifies that truck drivers are required to take breaks after driving for 11 hours within a 14-hour timeframe. The break can be no less than ten hours in duration.

If the truck driver is employed by a carrier in daily operation, then they cannot work more than 70 hours per week within a timeframe of eight consecutive days. All the truck driver's hours also need to be logged so that the FMCSA can enforce these rules and regulations.

However, some truck drivers choose to falsify these logs so they can drive longer than the regulations outline. This could be because they are in high demand or they are rushing to meet their deadlines. In any of these cases, this is considered reckless behavior on the part of the truck driver because it is for personal gain and puts the public at risk.

Some trucking companies have even asked truck drivers to falsify their logs so they can meet their goals and have the driver work even harder and faster than before.

The Consequences

Doing this can lead to dire consequences. When logbooks are falsified, everyone on the road is ultimately put at risk. The truck driver may become drowsy while driving since they are pushing the extra drive time, and this can lead to some significant impairments while driving.

Driving while tired can be compared to driving while under the influence of alcohol. Both can result in death or serious injury when there is an accident. Driving while fatigued lowers the driver's perception, slows down their reflexes, reduces their coordination, and it all results in poor judgment.
They can also fall asleep while driving the truck which is one of the most dangerous consequences of falsifying the drive logs and failing to take the mandated periods of rest. They can veer into another lane, crush a vehicle next to them, and even roll over after a collision causing more death, serious injury, and destruction.

If you have been involved in a truck accident and you have suffered injuries and damage, then you may be entitled to compensation. In this case, you should seek the professional counsel of an experienced personal injury attorney who can review your truck accident claim.

Often, these claims can become complicated because it not only involves the truck driver, it also involves the company that driver works for, the owner of the truck, the dispatcher, and sometimes even the manufacturer or the cargo that driver was carrying.

So, if you were involved in a truck accident, consult an attorney today as you seek compensation for your injuries.

I used Michael Babboni and his paralegal, Nicole Moore for a legal matter. They went above and beyond my expectations. During the entire process there was constant communication with both Michael and Nicole. They were extremely organized and on top of my case, which I am very grateful for. Michael truly had my best interests at heart and he was very genuine. I plan on referring Michael to all family and friends and will continue to use him in the future.

I dealt most with Mr. Fernandez. I didn’t know a lot about this process. He took the time to speak with me individually, in person, to explain everything. It was very helpful to actually know and understand the process and what to expect. He closed my case quickly, which was nice that it was not prolonged! I appreciated his hard work and getting me what I felt I deserved after my car accident. I highly recommend him to anyone who needs an honest and reliable lawyer to assist you with your case!

I hired Mr. Walsh after an automobile accident this past March. He and his entire staff were extremely professional. They kept me informed every step of the way and settled my case in a timely manner. Thank you so much for your help.
